The Supreme Court of Justice of Paraguay has approved a resolution establishing an institutional policy for the use of artificial intelligence systems within the judiciary.
The regulation defines criteria for their application in data processing, information management, and assisted decision-making, grounded in principles of ethics, transparency, and respect for human rights. It also ensures that these tools serve as support mechanisms and do not replace human intervention in judicial processes.
This milestone is part of a broader international context shaped by the adoption, in 2025, of the Guidelines for the Use of Artificial Intelligence Systems in Courts and Tribunals by UNESCO. These guidelines represent the first global framework establishing principles, safeguards, and practical recommendations to ensure that AI strengthens rather than replaces people-centred justice. They promote key elements such as human oversight, transparency, auditability, and the protection of fundamental rights throughout the entire lifecycle of AI systems.
The approved policy is the result of sustained technical cooperation between the Supreme Court of Justice of Paraguay and UNESCO’s Regional Office in Montevideo. This collaboration enabled a comprehensive approach combining specialised technical assistance, the exchange of international best practices, and an ongoing training process for judges and judicial staff.
Within this framework, UNESCO supported the strengthening of capacities across Paraguay’s judicial system, promoting training initiatives focused on the scope, risks, and opportunities of artificial intelligence. This capacity-building process was essential to translating international standards into practical tools for judicial decision-making.
The new regulation establishes that artificial intelligence must be used strictly as a support tool, without replacing human judgment. It also introduces the obligation to provide information about its use, particularly in cases where it may affect rights or guarantees, thereby reinforcing institutional transparency and public trust.
These principles are fully aligned with UNESCO’s approach to AI governance, which emphasises human rights, accountability, and the central role of people in decision-making processes.
Paraguay’s experience stands out as a regional benchmark in Latin America and the Caribbean, demonstrating how international cooperation, judicial training, and robust regulatory frameworks can converge to enable the responsible adoption of artificial intelligence in the justice system.
